Terms and Conditions
In these Terms and Conditions “we, our, us, the website or site” refers to Dark Star Magick, LLC. Dark Star Magick is registered in the State of Oregon, United States, the laws of which are considered to govern the terms of this agreement.
ACCEPTANCE OF TERMS
By accessing the content of DarkStarMagick.com, you agree to be bound by the Terms and Conditions and Privacy Policy set out herein. If you object to any of the terms and conditions set out in this agreement, please do not purchase items on this website. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
If you are under 18, you may use our website only with involvement of a parent or guardian.
Dark Star Magick, LLC reserves the right to change any part of this agreement without notice and your use of DarkStarMagick.com will be deemed as acceptance of this agreement. It is recommended to regularly check the Terms and Conditions of this agreement. Dark Star Magick, LLC reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at any time.
LAYAWAY
The Dark Star Magick Layaway Program is run through Partial.ly Payments Plans and Stripe. A Partial.ly account is required to process the payment and is free to set up. A minimum 50% down payment is required up front and the remaining balance due in 1 month, with the option to pay off the order at any time. Payments will be billed automatically by Partial.ly via Stripe Processing. For full Partial.ly terms, please read their terms and conditions here.
There is no service fee for layaway. The first 20% of your payment is non-refundable in the event of a cancellation. The items you purchase will be pulled from inventory immediately and will ship promptly upon receipt of the final installment. Late payments will be charged in the amount of $10 per occurrence – please make sure your funding source is able to cover your payments! Dark Star Magick, LLC is not responsible for fees charged to you by Partial.ly.
In the event that you are unable to pay and/or your account is over 7 calendar days overdue, the transaction will be cancelled, the item returned to inventory, and your payments (minus the first 20%) will be refunded to you. Any monies still owed to Partial.ly in the way of fees or charges will be the responsibility of the purchaser alone.
SHIPPING POLICY
Although we strive to process and mail orders within 1 business day, please allow up to 3 business days handling time. While we strive to ship your package as fast as we can, we are not responsible for delays in shipping. Please remember that media mail and international shipping can take extra time.
PLEASE NOTE: Due to increasing postage costs, as of January 1, 2024 we will no longer offer free shipping.
United States – Shipping options include USPS Media Mail and USPS Priority/Express Priority. Sorry, we do not ship UPS or FedEx at this time.
International – All International orders are sent either via Priority, Express Priority Post or DHL Express.
IMPORTANT NOTE REGARDING BREXIT AND EU VAT LAWS
Buyers in the above regions bear sole responsibility for any customs and import taxes that may apply. We are not responsible for delays due to customs or pandemic safety measures.
RETURNS
If you are unhappy with your purchase, please contact us within 7 days of delivery of the item (per USPS tracking information). We will do our best to provide a suitable remedy which may include a credit, exchange or refund. Please do not return the item before contacting us!
Please retain all the original packaging, including postal packaging and be ready to supply photographs of both in the event of damage. This is crucial as all items are insured. Failure to provide proof of damage during delivery may result in the return being denied.
Your item must be in its original unused condition to be returned, unless there is a manufacturer defect or it was received damaged and you have notified us of this damage prior to returning the item. If you are seeking a refund please tell us in your email what you want to return, when you purchased it, quoting our order or invoice number if possible, and why you wish to return it.
We are not liable for any items lost in transit while being returned to us, so please package the item carefully in it’s original packaging (if the packaging is damaged check with us whether we wish you to send back the original packaging). Please obtain a tracking number when returning items.
Except where the item was faulty, damaged or was significantly at odds with the description you will be responsible for the cost of returning the item. In the event that we have agreed to reimburse postage costs please send us a copy of the receipt. No refund or reimbursement of any costs incurred in returning the item or refund will be issued until the return has been received by us. Refunds for items returned that are not faulty and which were as ordered will be provided as store credit, excluding postage and packaging and less a restocking fee of 20%.
Refunds will be provided via the original payment method (ie. credit card used, PayPal, etc.)

The Dark Star Magick and Dark Star Press trademarks may not be used in connection with any product or service that is not Dark Star Magick’s without express written consent. DarkStarMagick.com grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify the site or any portion of it, except with express written consent of Dark Star Magick, LLC. This license does not include any resale or commercial use of this site or its contents: any collection and use of any product listings, descriptions, or prices: any derivative use of this site or its contents: any downloading or copying of account information for the benefit of another merchant: or any use of data mining, robots, or similar data gathering and extraction tools.
